“What Happens if a Presidential Candidate Is Convicted?”

A NY Times explainer. A couple of additional points on this. First, the article states: “Mr. Debs ran for the Socialist Party in 1920 and received about 3 percent of the vote.” True, but it might be worth noting also that he received about 6% of the national popular vote in 1912 when he was not imprisoned, or almost double his 1920 amount. Second, the article does not address the possibility that Trump might still be indicted and convicted for his role in the January 6 attack on the Capitol under the insurrection statute, 18 U.S. Code § 2383, which would raise different disqualification questions, as has been discussed recently in previous ELB posts, including yesterday’s comparison of Trump and the nation’s insurrectionist/treasonous Vice President and presidential candidate John C. Breckinridge.
