I know this is far afield from this blog’s focus, but this is such an interesting constitutional issue, with significant practical implications, that I wanted to flag it here for those interested in constitutional law. The en banc Fourth Circuit divided 10-6 on the issue. I wouldn’t be surprised if the Supreme Court took up the case.
