In advance of today’s scheduled vote of the Otero commissioners on whether to comply with the state supreme court’s mandamus order to certify the election, one commissioner (the one who is being sentenced today for participating in the January 6 insurrection) reportedly has announced that he will not vote to comply. He faces potential additional criminal consequences for this refusal.

It’s unclear how the other commissioners will vote. Another story quotes as second commissioner as “incredibly dismayed” by the New Mexico Supreme Court’s order and as having doubts about the election as the reason for not certifying the election.
