Fifth Circuit Reverses Party Identification & Voter ID Ruling

The Fifth Circuit yesterday issued this opinion in Mississippi State Democratic Party v. Barbour, reversing a lower court opinion that had declared Mississippi’s semi-closed primary statute unconstitutional and had required both party identification and photo ID to vote in a party primary. The Fifth Circuit opinion, authored by Judge Edith Jones, purports to “put the parties out of their litigation misery,” finding plaintiffs’ claims nonjusticiable.
