“Legal expert betting on city; He likes chances of high court hearing election reform case”

The Modesto Bee offers this report about Sanchez v. City of Modesto, a California appellate court case that may be appealed to the U.S. Supreme Court. The case arises under the California Voting Rights Act, and raises the interesting question whether strict scrutiny applies to the Act’s requirement that Modesto eliminate its at-large city council in favor of districted elections. I noted first here that “[g]iven the issues of race and strict scrutiny presented in the case, I would give this case a fair shot at being heard by the U.S. Supreme Court if the city of Modesto decides to go forward with a petition for cert.”
