Obama Donations, Coordination, and the ActBlueFEC Advisory Opinion

On the new Political Insider website, a sister site to the indspensable Political Wire site, there’s a post referring to this ad for a group called “Obama4America.” The Political Insider post says: “We’re told the Barack Obama advertisement on this and many other blogs to ‘kickstart his campaign’ is a real ad placed by Obama’s people.” I’m not sure who “Obama’s people” are supposed to be, but this looks to be an uncoordinated ad.     What if he decides not to run?
    ActBlue’s policy is simple: All donations go to Senator Obama if he runs. If not, it goes to the Democratic National Committee. This way, even if Senator Obama does not run for president, you can be confident that your donation will help send a Democrat to the White House in 2008.
    How can ActBlue legally do this?
    The process for collecting contributions to undeclared presidential candidates is new to this election cycle. The Federal Election Commission ruled on November 9, 2006 that ActBlue could legally collect earmarked funds for undeclared presidential candidates and hold those donations in individual escrow accounts.
