The San Antonio Express News reports that the panel selected to hear oral arguments in the Tom DeLay ballot access case Monday “will have a majority that was named to the court by then-President Bill Clinton: Judges Pete Benavides of Texas and James L. Dennis of Louisiana. The third judge will be Edith Clement, originally from Alabama.” On the rather conservative 5th Circuit, that is not a great draw for Republicans.
