It is a position courts have rejected, and analogous to Jim Crow language I believe is unhelpful in the voter id debate.

But it is becoming clearer, as I argue in The Voting Wars, that perhaps the biggest function of the debate over voter i.d./voter fraud these days is to fire up the base and fundraise (on both sides of the aisle).
