At issue is whether the Prop. 8 plaintiffs have standing to defend the measure when state officials won’t do so.  The opinion will be released at 10 am.  My prediction is that the Court will unanimously say that there is such standing, and I think this is the right result.

The Ninth Circuit asked for this state law question to be resolved by the CA Supreme Court and will not be bound by it in deciding whether the plaintiffs have standing in the federal case.
