The case was slated for discussion at the last conference. It was the first listing, so it could well be relisted, particularly if there are some Justices who want to summarily affirm the case rather than slate it for a hearing. If it is relisted, given the summer recess, it may be a while before we hear about the case’s fate. On the other hand, this case comes under the BCRA statute asking for expedited review, so perhaps we will hear something Monday morning.
I continue to believe, in contrast to Adam Liptak, that a summary affirmance is likely in this case.
