U.S. Moves to Dismiss or Affirm in RNC Soft Money Case

SCOTUSBlog has the details on this filing today in the Supreme Court in the RNC v. FEC case.
I continue to believe that a summary affirmance is possible in this case. After all, this filing notes that “Appellants do not urge this Court to overrule McConnell or any other precedent.” Then again, that didn’t stop the Court the last time.
One interesting question is whether SG Kagan would recuse herself if she is confirmed and the Court hears the case afterwards. She did not sign this brief, but we don’t know if she had any involvement in it earlier in the process.
