a lawsuit challenging the districting in Irving Texas. It is a one person, one vote lawsuit challenging the counting of non-citizens in complying with the one person, one vote requirement.
Certainly for purposes of apportioning the number of Representatives in each state, it is constitutionally required to count all “persons.” It is hard for me to see the basis for saying that a state (or city’s) decision to count all “persons” (including non-citizens) for drawing single member districts within a jurisdiction is unconstitutional.
I’ll be keeping my eye on this one.
