After a panel of the Fifth Circuit found that the Galveston County, Texas map likely violated Section 2 of the Voting Rights Act, the en banc court stayed the order and allowed the old maps to remain in place while en banc argument proceeded. Plaintiffs asked the Supreme Court to lift the stay. Today, it refused to do so–the old maps will remain in place while the Fifth Circuit en banc hears argument. Justice Kagan, joined by Justices Sotomayor and Jackson, would have vacated the stay, for the reasons set for in this brief statement here.
