I blogged earlier about John Eastman arguing for the decision against him to be vacated on grounds it is moot. I wondered if a response would be filed by the Jan. 6 committee, which I think no longer exists. There is nothing on the docket showing any filing by the committee, with the cert opposition due yesterday. Chapman University (which produced Eastman’s emails for the committee under court order) waived its response to the cert. petition.

So I’m really not sure what the Supreme Court will do in this instance if they think that Eastman’s argument has any potential merit. Stay tuned.
