Independent State Legislature Theory, Voting Rights Act Watch Today

The Supreme Court hands down opinions today at 10 am EST. The Alabama Voting Rights Act case, Allen v. Milligan, is the only argued case from the Court’s first sitting in October that has yet to be decided. The two Justices who have not yet written a majority opinion from that sitting are Chief Justice Roberts and Justice Thomas, so there’s a good chance one of those will be writing the majority.

As I noted earlier this week, if the Court is going to dismiss Moore v. Harper, today would be one likely day for that. The Court has now had the latest filings by the parties for long enough to resolve that issue.
