Marc Elias writes in the Democracy Docket. ELB readers know that fellow ELB blogger Derek Muller has posted here a somewhat different perspective on this matter. A hearing is scheduled for July 28. I will be looking to see whether the litigation is resolved in a way that is consistent with the principle that a statewide election needs a single rule on whether identically cast ballots are entitled to be counted or not (and, if they are entitled, whether the winner of the election is identified and declared based on the equal counting of all these valid ballots).
