With all the talk about whether the evidence presented at the January 6 committee’s hearings provide a basis for prompting Merrick Garland to bring criminal charges against Trump, the public discussion of how best to protect the nation’s democracy from the ongoing threat that Trump presents should not overlook the possibility of using the committee’s evidence as the predicate for a new federal statute to enforce the disqualification clause in section three of the Fourteenth Amendment. To that end, I have written a Washington Post column raising the point.
