I very much enjoyed talking with Scott Anderson about the need to revise the Electoral Count Act in order to mitigate the risk of Congress, in a future joint session under the Twelfth Amendment, subverting a valid Electoral College victory (along the lines of what some members of Congress wanted, and attempted, to do on January 6, 2021). We also discussed how a well-revised Electoral Count Act can also address the risk of officials within state governments, including state legislatures, attempting to subvert valid popular vote victories of presidential candidates within their states.
