Nationwide preclearance for congressional elections

For my inaugural post as part of ELB’s new format (and I’m honored to be on board–thanks, Rick), here’s a new Washington Post column. Given Brnovich, it proposes nationwide preclearance but limited to congressional elections as a way to repair section 2 of the VRA as well as section 5. Also, because the proposal would rely on Congress’s power under Article 1, rather than the 14th or 15th amendments, nationwide preclearance could address the problem of partisan gerrymandering as well as racial discrimination in voting. All that’s needed is 60 Senate votes or sufficient filibuster reform.
