You can find the 2-1 opinion here. Judge Griffin dissented solely on the majority’s decision to reverse the district court TRO barring Sec. Brunner from enforcing her directive to local elections boards to bar election observers from early voting sites. Judge Griffin cited the potential for irreparable harm if observers are not in place to protect against fraud and what the judge views as a lack of any harm from having observers present.
The Ohio Supreme Court, which had earlier ruled for Sec. Brunner in a state law challenge to the five-day window, issued this 4-3 opinion explaining its reasoning.
