Supreme Court Acts in Dallas County Voting Machine Case

Back in June, Richard Winger noted the oddity of the Supreme Court’s failure to act before the end of its term in a case involving an appeal related to voting machines used in Dallas County.  Today, with the Supreme Court back in session,  the Court issued two orders related to the case.  It dismissed one appeal as moot, presumably because the DOJ had precleared the use of the machines in the interim.  In the other order, the court dismissed and said that the appeal of this order must come from a single judge to the 5th Circuit, and not directly to the Supreme Court via a three-judge court.

I have not seen the pleadings and I am not sure what other claims are in the case which can now be appealed to the 5th Circuit.

Here is a brief AP story.

UPDATE:  Richard Winger reports that the second appeal in the Dallas case relates to attorneys fees.  He also discussses Supreme Court action in other election law cases.
