The FEC also declined to appeal. The three Republican Commissioners issued a very strong dissent from the FEC’s decision not to appeal this van Hollen case (it would take a vote of four commissioners to appeal). I expect this statement to get heavy play as the intervenors seek a stay from the D.C. Circuit, and potentially from the Supreme Court. Two of the three Democratic Commissioners issued their own statement explaining their decision not to appeal.
