Big Developments in LaRoque Voting Rights Case (Kinston)

Big news: The government precleared the Kinston change, DOJ moved to dismiss the lawsuit on grounds of mootness, and the DC Circuit ordered the case, which was to be argued today, taken off calendar pending resolution of the mootness question.

This means that barring some emergency application to the Court (perhaps in the Texas or South Carolina voter id case), the Shelby County case (currently awaiting opinion before the D.C. Circuit) seems the most likely candidate for a case for the Supreme Court to address the issue left open in the NAMUDNO case: is section 5 of the Voting Rights act still constitutional?
