If Wisconsin were subject to preclearance under section 5 of the VRA, this piece of evidence could have well led DOJ to reject Wisconsin’s new voter i.d. law.

But only certain states covered under this part of the VRA (including, currently, South Carolina) must submit their new voter i.d. laws for preclearance to the Department of Justice or a three-judge DC court.
