By letting Congress apparently take the lead in investigating Trump and his inner circle and by doing a poor job of coordinating its efforts with the Jan. 6 committee, the department has undermined its own chances at successful prosecutions of Trump and those closest to him.

In fact, the committee’s bombshell hearings have only underscored the risks of DOJ’s approach: Key witnesses have now provided multiple interviews that can be used to discredit them or undercut their testimony if they ever take the stand in a criminal trial.
