Brad Blog Takes Apart, Bit by Bit, the Easterbrook “You Need an ID to Do X” Analogy

Here.

What really gets me is how Judge Easterbrook takes a difficult and complex issue and gives it the back of its hand—whether it is his rejection of the district court’s finding that up to 9% of Wisconsin voters don’t have the right kind of ID for voting or how to apply section 2 of the Voting Rights Act to vote denial claims.  It was the shortest and most superficial discussion I’ve seen. Compare it to the much more thoughtful (and equally conservative) district court opinion in the North Carolina voting case.
