“REPORT: Thousands Disenfranchised by Inconsistent Handling of Provisional Ballots”

A national review of provisional ballot counting rules, contained in a report released today by the Fair Elections Legal Network, underscores that a minority of states continue to reject votes cast for important higher offices when mistakenly cast in an incorrect precinct even though the voter would have been eligible to vote for those offices in their home precinct.

The report, Saving Votes: An Easy Fix to the Problem of Wasting Provisional Ballots Cast Out of Precinct, concludes that tens of thousands of provisional ballots are never opened because the voter cast his or her ballot in the wrong location. Twenty-two states continue to reject these ballots in full, discarding even votes for Governor, U.S. Senator and President.
