Federal Court in San Diego Issues Clarification: Independent Expenditure Committees May Accept Unlimited Sums from Corporations, Labor Unions, and Others

Following up on this post, the federal district court in San Diego has issued this clarification order, which will allow independent expenditure committees to accept unlimited sums from corporations, unions, and other non-individual entities in San Diego candidate elections.

I believe this ruling goes further than the D.C. Circuit might go in the SpeechNow case, because there I think the plaintiffs are all individuals, not entities, who are claiming the right to make unlimited contributions to independent expenditure committees.

No word yet on whether this ruling will be appealed.

Disclosure: I am co-counsel for the City of San Diego in this matter.
