FEC Draft Opinion Would Permit Sen. Obama to Return Funds Solicited for General Election if He Later Accepts Public Financing

See the draft here. The FEC will vote on the draft on March 1. From my quick look, the draft does not respond to the "plain meaning argument" (think Fred Wertheimer channelling Justice Scalia) made in the somewhat surprising comments of the Campaign Legal Center and Democracy 21.
