I’ve only had a chance to briefly skim California Pro-Life Council, Inc. v. Randolph, but I have to say I’m troubled with my first impressions. It appears that the court has applied strict scrutiny to a set of disclosure laws applicable to ballot measure committees, and held that the ballot measure’s detailed requirements for disclosures by PACs cannot be applied to at least some ballot measure committees. The court does appear to uphold basic contribution and expenditure reporting requirements. More later if I have time to study this in more detail.
