The Supreme Court’s opinion in Purcell v. Gonzalez (my analysis here) on the Arizona voter id law concerned only a preliminary injunction. The case has now made it back to the Ninth Circuit, and here is the AP report. The panel consists of Ninth Circuit judges Schroeder and Noonan, and district court judge George Schiavelli sitting by designation. Judge Schiavelli, from the AP reports, sounds quite skeptical of this challenge to the law. I know Judge Schiavelli; he was a partner at Horvitz and Levy, where I worked before practice and continue to consult. He’s very smart, and pretty conservative. With this panel–and especially after the Supreme Court’s earlier opinion—I expect the challenge to the law to fail.
