Time for Notice and Comment on DOJ Changes to Its Section 5 Preclearance Rules

See this NPRM. Pay particular attention to sections 51.54 to the end, which provide the standard the DOJ proposes to use in reviewing redistricting plans and otherwise determining discriminatory purpose and effect. The final version of these rules will no doubt be part of litigation over section 5’s constitutionality somewhere down the line.
