Via Ken Vogel comes a link to this internal Clinton White House memo, dated Oct. 31, 1996, and authored by six people, giving talking points supporting the 1996 version of the McCain-Feingold legislation (which did not pass, by the way).
What insight does this give us into SG Kagan’s thinking on the constitutional issues? Nothing. Besides the fact that this is old and co-authored, the assignment here was to give talking points, not to give an internal frank analysis of the constitutional issues in the McCain-Feingold law.
