“And the Winner Is….Me”

Yesterday’s NY Times offered this editorial, which begins: “Voters in Ohio can be forgiven if they feel they have been beamed out of the Midwest and dropped into a third-world autocracy. The latest news from the state’s governor’s race is that the Republican nominee, Kenneth Blackwell, who is also the Ohio secretary of state, could rule that his opponent is ineligible to run because of a technicality.” Besides the other arguments, such a claim to remove Strickland undoubtedly should fail on laches grounds.
UPDATE: Undoubtedly was too strong a word. Brad Smith makes a good argument that because residency is determined 30 days before the election, laches may not apply. More analysis of the merits of the argument here at Moritz.
