I just learned of this oral argument order which was issued back on Sept. 17 in SEIU v. Husted.  Two of the judges on the panel are Judges Gibbons and Cook. The third judge, Judge Rosenthal, appears to be a judge sitting by designation and I’m not even sure which Judge Rosenthal this is.

But in any case this is not good news for those concerned that the Sixth Circuit could hold that a voter may be disenfranchised when the voter casts a ballot in the wrong place due solely to poll worker error.  What kind of error? Like a poll worker not knowing the difference between odd and even numbers in addresses.
