Breaking (Non-)News: No Ruling in Montana Supreme Court Sequel

The Supreme Court has issued its orders and opinions today, with no word on a summary reversal or a cert. grant in the Montana case.

What does this mean?  It could mean that there is a summary reversal coming, but the Court is waiting for one or more Justices to write dissents or additional opinions as to the summary reversal. (I expect if there is a reversal, at least Justice Ginsburg would write something given her earlier unusual opinion with respect to the stay in the case.)

On the other hand, i recall that the Texas re-redistricting cases were relisted 5 times on the Court’s conference list before the Court ultimately agreed to hear the case rather than issue a summary disposition.

So we could hear something by the end of the term’s argument days  (likely next Thursday), or something could come right before the first Monday in October (or even later)
