An AFER press release says: “Tomorrow, the Ninth Circuit is expected to issue a filing at 10a.m. PST in the Perry v. Brown case, the Proposition 8 case.”

This will likely be an order on whether or not the Ninth Circuit will take the case en banc.  If it does not take the case, it is likely there will be at least a dissent from that position.  If the court takes the case, it wipes out the original order and the case would be heard before a larger panel of Ninth Circuit judges.

My speculation: en banc denial with a dissent.  But it is just speculation.
