Judge Smacks Down FEC in Attorneys Fee Ruling in Carey Case

Judge Collyer  criticized the agency for “erroneously contend[ing] that two of its commissioners were reasonable for believing the Circuit opinion in EMILY’s List was not binding on the agency.”  As a longtime reader points out to me, the opinion also sarcastically notes, “the FEC is supposed to be an expert on federal election law.” (id.)
