Breaking News: Judge Temporarily Enjoins Wisconsin Voter ID Law on State Law Grounds

The state court judge’s opinion, exclusively on state law grounds, is here. See also these news stories. This is separate from the recently-announced federal lawsuit against Wisconsin’s voter identification law.

The question of whether the law violates the state constitution is a matter for state law, so almost certainly these claims will end up before the Wisconsin Supreme Court. That court is divided 4-3 in favor of Republicans, so it is far from certain that this ruling will stand.  But if the Wisconsin Supreme Court rejects the state claims, there may still be federal claims to bar the suit.  I believe those federal claims will have a tough change of succeeding.
