Justice Kennedy: Forget About Section 5 in Texas Dispute?

So reports Lyle Denniston in this early post on today’s argument in the Texas redistricting cases.  It sounds from this early AP report that the direction the Court would go is unclear.  Justice Kagan’s suggestion, as reported by Lyle, sounds like a reasonable compromise, but would be tough on Texas if the courts relied upon the recent D.C. court opinion which strongly suggested parts of the redistricting plans are unlikely to be precleared.
