Shelby County Appeal Gets Expedited Consideration, Argument Date, and a D.C. Circuit Panel

The case will be heard by Judges Tatel, Griffith, and Williams on January 19, 2012 at 9:30 am.  Judge Tatel, of course, was the author of the three-judge district court opinion in NAMUDNO, which held that section 5 of the Voting Rights Act is a constitutional exercise of Congressional power.  I think we can expect him to reach this conclusion again.  Where the other judges are likely to be is harder to say, but Judge Bates, the district court judge who decided Shelby County, was a Bush II appointee.  My earlier analysis of Judge Bates’ opinion is here.
