ACORN May Be Gone, But an Important Constitutional Case About Their Activities Lives On

Amy Busefink of Project Vote entered an Alford plea in a Nevada trial court to a charge of conspiring to violate Nevada’s laws barring the compensation of persons for voter registration activity based upon the number of total registrations collected.  But Busefink reserved the right to challenge the constitutionality of the Nevada statute on First Amendment grounds.

Busefink’s lawyers have now filed this brief in the Nevada Supreme Court raising the constitutional question.  Project Vote has filed this amicus brief. The state’s response in Busefink v. State of Nevada is due in mid-September.

Should be an interesting one to watch.
