Here’s what’s happening.  John Edwards was indicted.  I’ve put up a short post at Volokh on this, and I’m writing something more extensive about this, which should appear soon.

Judge Catheris heard oral argument this morning on the motion for reconsideration this morning in the Virgina corporate contributions case.  Here’s a notation that just appeared on the docket: “Minute Entry for proceedings held before District Judge James C. Cacheris:Status Conference as to William P. Danielczykk, Jr, Eugene R. Biagi held on 6/3/2011. Appearances by counsel; appearance waivers filed by the defts. Motion for reconsideration of court’s dismissal of Count 4 and paragraph 10(b) of the Indictment heard; matter taken under advisement. Defts on bond. (Court Reporter J.Goodwin) (nmcc) (Entered: 06/03/2011).

So Judge Catcheris could rule on the motion for reconsideration any time.
