“Date Blamed for Low Vote in [New York] Primaries”

And really, if you read the NY Times article, the MOVE Act is apparently being blamed for the date change, which is being blamed for 5% turnout on Tuesday — less than the 7% turnout for New York’s presidential primary.

Make no mistake: whatever the cause, the solution has to involve efforts to better inform voters, rather than critique of the decision to schedule elections so that servicemembers can effectively participate.

“Change to Ballot Request Form Angers U.S. Expats”

NYT: “The Pentagon office with responsibilities for assisting U.S. military and civilian overseas voters is issuing a new ballot-request form that requires civilian voters to make an all-or-none declaration either that they plan to return to the United States or have no intent of ever doing so. Expatriate groups say the choice is confusing and unfair, carries potential tax ramifications and could depress voting in ways that might affect close elections in November.”

“Call to Duty: Military members at risk of missing WI vote”

The Wisconsin Reporter has this item. “In preparation for the state’s GOP presidential primary and spring election Tuesday, municipal clerks were required to send absentee ballots to overseas and military voters by Feb. 18, or 45 days before the election, as the MOVE Act requires for federal elections. At least 63 of Wisconsin’s 1,851 municipal clerks failed to meet the deadline, with delays ranging from two days to nearly a month. The latest ballots went out March 15, one each from Jefferson and Oconto counties.”

Laches and election-law: “Piling on” edition

In this post, Rick pointed out one substantial downside of last-minute election claims.  I made a similar point in this Article, in the context of litigation challenging election-day burdens like lines at the polls (and citing the discussion Rick blogged about).  Where (and only where) the conditions likely to cause the problem are known well in advance, early resolution based on a probabilistic assessment of likely harm benefits the system as a whole.  (But see Crawford…)

And while Rick’s discussion here focuses on pre-election v. post-election relief, the Article above builds on Rick’s point in a different piece: even pre-election, logistical difficulties increase the later it gets in the election cycle.   (In a way, this is the second state where Perry’s involved in a pragmatic election administration mess caused by unresolved last-minute litigation, though technically, laches aren’t — and shouldn’t be — at issue in the Texas case).  The Virginia election isn’t until March 6, but absentee ballots should already have been printed, and have to be mailed in less than a week.   Even if the choice at hand doesn’t threaten to overturn the results of an election, it’s already making it more difficult to actually run the election in question.
